1. Our approach
Datafalk Inc. ("Datafalk") respects the intellectual property rights of others and expects its users to do the same. Datafalk responds to notices of claimed copyright infringement concerning material stored on the Services by its users in accordance with the United States Digital Millennium Copyright Act ("DMCA", 17 U.S.C. § 512), and reviews complaints concerning the content it publishes itself under Section 7. Datafalk may remove or disable access to material that is alleged to infringe.
3. Notice of claimed infringement
To be effective under the DMCA, a notice must be in writing and include: (a) a physical or electronic signature of the owner of the copyright or of a person authorised to act on the owner's behalf; (b) identification of the copyrighted work claimed to have been infringed, or a representative list if several works are concerned; (c) identification of the material claimed to be infringing and information reasonably sufficient to permit Datafalk to locate it, such as the URL; (d) your name, address, telephone number and email address; (e) a statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent or the law; (f) a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed. A notice that substantially complies with these requirements is processed; where a notice is materially incomplete, Datafalk contacts the sender to obtain the missing elements where the law so requires. Knowingly misrepresenting that material is infringing may expose you to liability for damages under 17 U.S.C. § 512(f).
4. Counter-notification
If material you stored on the Services has been removed or disabled following a notice, Datafalk informs you promptly. If you believe the removal was the result of a mistake or misidentification, you may send a counter-notification to the designated agent including: (a) your physical or electronic signature; (b) identification of the material removed and the location where it appeared before removal; (c) a statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification; (d) your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, of any judicial district in which Datafalk may be found), and that you will accept service of process from the person who provided the original notice or its agent. Upon receipt of a valid counter-notification, Datafalk forwards it to the original complainant and restores the material not less than ten and not more than fourteen business days after receipt of the counter-notification, unless the complainant informs Datafalk that it has filed an action seeking a court order against you. Datafalk explains any other lawful ground that prevents restoration.
5. Repeat infringers
Datafalk terminates, in appropriate circumstances, the accounts of users who repeatedly infringe the copyright of others, taking into account valid notices and counter-notifications, and accommodates standard technical measures where applicable.
6. Notices of illegal content from the European Union and elsewhere
Any person or entity may notify Datafalk of content stored on the Services by its users that it considers illegal, including content infringing intellectual property rights, by writing to legal@datafalk.com with a sufficiently substantiated explanation of the reasons, the exact electronic location of the content, the notifier's name and email address except where the law allows anonymity, and a statement that the notification is made in good faith and that the information provided is accurate and complete. Datafalk acknowledges receipt, processes the notification diligently and informs the notifier and, where applicable, the user concerned of its decision and of the available means of redress, in accordance with Regulation (EU) 2022/2065 where that Regulation applies to the hosting activity concerned. No declaration under penalty of perjury or proof of copyright ownership is required for such a notification.
7. Content published by Datafalk
Datafalk collects information from public sources and licensed datasets under its Public Data Collection Principles, records its sources, extracts facts, relationships and references, and relies on the applicable exceptions for text and data mining and on its licences. A rights holder who considers that content published by Datafalk, including Atlas pages and maps, reproduces protected content beyond what those exceptions and licences allow may notify Datafalk at legal@datafalk.com, identifying the protected work or right, the content and its location, the reasons for the complaint and contact details sufficient for a reply; Datafalk may request reasonably necessary supporting information, and the declaration under penalty of perjury of Section 3 is not required unless the applicable legal procedure requires it. Datafalk reviews the notice and, where it is founded, removes or reduces the content concerned to the facts and references it is entitled to use, and records its decision. This Section describes a review procedure; it does not constitute an admission of liability.
