Our paid offers are reserved for professionals. This policy distinguishes between the restoration of a credit to your account and the refund of a sum to your payment method. Capitalised terms have the meaning given to them in the Terms of Sale.
Technical failure or Page not unlocked. If a Generation fails before completion for a cause attributable to the Service, or if an Unlock is not performed, the Credit concerned is restored to your account without further payment. It retains its original expiry date or remains valid for thirty days from its restoration if that period is more favourable, including after the end of a Subscription.
Maximum delivery time exceeded. If a Map is not delivered on expiry of the maximum delivery time indicated before triggering, you may cancel the request from your account; the Credit is then restored.
Repeated failures and lasting impossibility. If, for the same request, processing fails or the maximum delivery time is exceeded three times, you may request a refund of the Credit concerned instead of a further attempt. If a paid service becomes impossible to perform on a lasting or permanent basis, including for a cause not attributable to Datafalk, it is terminated and its unperformed part is refunded.
Non-conforming Map or Page. A Map that relates to an entity other than the one requested, that is truncated by a technical error or that does not contain the elements required by the Terms of Sale (identification of the scope, date, relationships with their sources and confidence levels, research report, exportable format), as well as a Page whose full version is not accessible, is corrected or performed again at no additional cost within fifteen calendar days of your report. The same applies to a Map or Page in which a cited source does not exist or does not describe the relationship it is supposed to support, in which a confidence level is assigned contrary to its definition, in which the entity is misidentified, or in which the scope processed departs from the scope requested. A Map identifying few relationships, or none, is conforming once it contains the report of the search carried out, as stated at the time of purchase and before each triggering; disagreement with a conclusion that is correctly presented and sourced does not constitute a non-conformity.
Persistent non-conformity. If correction is impossible, is refused, or is not achieved within the fifteen-day period, you may request a refund of the unperformed service or a proportionate reduction of the price. The restoration of a Credit is not your only remedy in that case.
Withdrawal of, or end of access to, a paid Deliverable. If online access to a paid Page or Map ends because of Datafalk, other than through a closure for breach on your part, making available an export of its full version satisfies our obligation. If that export is not possible, in particular where the law requires the removal of the content, the Credit consumed is refunded at the price actually paid or, if it was a Subscription Credit, restored to your account. A Subscription Credit is restored only if you can actually use it for an equivalent service; if that is no longer possible because of Datafalk, because of the closure of your account without breach on your part or because of the discontinuation of the Service, we grant a proportionate reduction or refund of the affected service, taking into account the price actually paid and the utility already provided, without applying the price of individual Credits and without double refund.
Closure of your account by Datafalk for breach. If we close your account after a formal notice has remained without effect, the statement of account distinguishes the services performed, which remain payable, from the prepaid unperformed part of your Subscription and your unconsumed purchased Credits, which are refunded to you at the price actually paid, less the sums that we demonstrate are owed to us on account of the breach. In the event of established fraud, threat to the security of the Service or unlawful use attributable to the Customer, the Terms of Sale provide for the retention of those sums under a liquidated damages clause (clause pénale under Article 1231-5 of the French Civil Code), under the conditions of their Article 17.4.
Calculation of the refund. For a Credit purchased individually, we refund the price actually paid. For a Credit from a Pack, we refund the price of the Pack divided by the number of Credits it contains. Promotional Credits are not refundable in money. For a Subscription Credit, we restore an equivalent Credit; if a persistent material non-conformity justifies the termination of all or part of the Subscription, we refund the part of the price corresponding to the unperformed period. Where only one of the two services of the Subscription (Generations or Unlocks) is unavailable on a lasting basis, the reduction is proportionate to the weight of that service in the offer and to the duration of the unavailability; the price of individual Credits is not applied to Subscription Credits. A refunded Credit is removed from the account and cannot give rise to a second refund. Taxes are adjusted in accordance with the applicable regime. There is no double refund.
Charging error. A duplicate charge or an amount wrongly charged is refunded to the original payment method, unless that is impossible or a legal constraint requires another method.
Stopping the renewal of a Subscription. You may stop the renewal from your account before the renewal date displayed. The Subscription continues until the end of the paid period; a period that has been performed is not refunded by reason only of the renewal being stopped. Stopping the renewal does not remove purchased Credits. Remaining Subscription Credits expire at the end of the Subscription, as stated before confirmation of the stop.
Closure or discontinuation of the Service by Datafalk. If we close your account or discontinue the Service without breach on your part, we refund the unconsumed purchased Credits, at the price actually paid, and the unperformed part of the Subscription, after allowing you to export your Deliverables during the notice period.
How to make a request. Write to billing@datafalk.com with your order reference and the reference of the Map or Page concerned. A report within thirty days of discovering the problem facilitates its handling; it does not shorten the statutory periods available to you. We respond within ten business days and issue any accepted refund within ten business days of agreement. The time it takes to appear on your account depends on your bank and on the payment service provider. Any shorter statutory period applies.
A conforming service does not give rise to a refund for a mere change of mind. This policy does not limit any mandatory rights you may have. The Terms of Sale set out the details of delivery, Credits, Subscriptions and account closure.
